Barriers for Adopting Electronic Health Records (EHRs) by Physicians Introduction In the article, â€Å"Barriers for Adopting Electronic Health Records (EHRs) by Physicians,† researchers analyze the resistance associated with adoption of EHR systems by U.S. physicians. Current research supports the notion that electronic health records are not vastly supported in the U.S., especially in comparison to other countries. According to researchers at the Weill Cornell Medical College, â€Å"Doctors who go digital do appear to provide significantly better health care† (Nordqvist, 2012). While there are many productivity concerns around implementing a new system, this article explains why physicians are resistant to the adoption of EHRs and how those oppositions can affect the system. Analysis of Key Issues In 2012 approximately 72 percent of office-based physicians had adopted any HER system and 40 percent had adopted basic EHR systems (King, Patel, Furukawa, 2012). While there are a myriad of issues associated with the adoption of EHRs nationwide, some of the most prevalent are miscommunication, misinformation and misinterpretation. Physicians are apprehensive about the level error that could prevail with using EHRs. Joseph Conn found that, â€Å"an alarming number of clinicians are anecdotally reporting a substantial increase in the incidence of wrong order/wrong patient errors wile using the computerized physician order entry component of information systems† (2013). Clearly physician resistance to EHRs is directly related to the safety of patients as an increased predisposition for error is being revealed. Conversely, EHRs can be equally superior as they can also contribute more accuracy to the healthcare infrastructure. The Missouri Health Connection shared that EHRs can pr ovide health records universally, â€Å"improving the coordination and continuity of care and promoting informed decision making† amongst many other things (n.d.). Findings Based on the results from the study there are 20 reasons that physicians are resistant to the adoption of EHRs; stemming from cost to doctor-patient relationship. With all the viable concerns that physicians have, they  remain resistant and the acceptance rate is still low. Personal Assessment The evolution of EHRs and its impact on Obamacare and the overall healthcare system is pioneering. Obamacare is based on the perception that health care in the U.S. is more expensive than any other industrial nation because the incentive configuration is inadequate. Ideally, the government would like for Medicaid and Medicare patients to be consistently healthy and otherwise reimburse the physicians for keeping them healthy. However, for this to work the government needs instant access to patient records. With this access the government can eliminate reimbursement solely on test and procedures but incentivize for health results. While EHRs are beneficial for physicians they are equally beneficial for patients. The ability to walk into any healthcare facility and the physician have access to your medical history is substantial. As it relates to someone with health complications, this can minimize the risk of misdiagnosis or allergic reaction. And you know I can do it. This exhibits what a nasty girl Abbey is, and the girls in the town are scared rigid of her and will do whatever she says. This demonstrates the kind of power she has over the girls. She uses the forcefulness of her personality on the girls of the town, this leads them to do whatever she says. John was in love with Abbey and she uses this against him, she exploits it over him to get him to do what she wants for example; She is blackening my name in the village. You sweated like a stallion whenever I came near. These quotes show how Abbey uses what power she has over John to get him to do what she wants. It shows that Abbey knows what power she has and when to use it. This sexual power is her main power and she uses it over everyone she can. Abbey Williams is a very cruel and arrogant person she insults the judges and is aggressive towards Danforth for example; Ill have no such looks! If I have to answer that I will leave and never come back again. This shows that she can say this to the judges and get away with it, and that Abbey even seems to have power over the judges and court officials. Abbey Williams pretends she was taken by the devil in order to get power over the people of Salem and to get what she wants, this shows how evilly twisted she is. On the other hand the Putnams have a totally different kind of power. They have the power of their material possessions. They are very wealthy, but they are greedy and they have a habit of claiming land that is not theirs for example; Your grandfather had a habit of calling land that never belonged to him. This leads the Putnams to be disliked in the town. The Putnams do have a lot of land most of it swindled from their neighbours and because the rest of the people in Salem arent as rich, lots of them are resentful towards the Putnams. All the Putnams sons have died; we learn this during the play When Mrs Putnam says; Reverend Parris, I have laid seven babies unbaptised in the earth. Believe me sir you never saw more hearty babies born. And yet they would wither in my arms the very night of their birth.

Leadership and Change in Nursing Leadership and Change Kym Bell I have chosen to use Jersey College in Trenton, New Jersey for my leadership change project. Jersey College is an educational nursing program that provides the combination of Licensed Practical nursing (LPN); Bachelor of Science in Nursing (BSN) and bridge programs for Registered Nurses (RN). The college is located in an urban setting with the student body predominantly from lower income families. The college provides, â€Å"education for adults through an open curriculum that accommodates diverse lifestyles† (Jersey College, 2014). The school prides itself on being the conduit to provide diverse opportunities for Certified Nursing Assistants (CNA), LPN’s, RN’s. The program provides the opportunity for LPN’s and RN’s to acquire a BSN. Jersey College was founded in 2003 and was originally called The Center for Allied Health Nursing Education. In 2004, the LPN program was approved by the New Jersey Board of Nursing. Since opening in 2004, the school has grown to incorporate two New Jersey campuses and two Florida campuses. The school is affiliated with many institutions who provide a variety of other educational opportunities for students (Jersey College, 2014, p. 1). In the past few years, there has been a decrease in the availability of nursing faculties and training sites for nursing students. This has increased the need for nursing instructors to look at alternative clinical sites. A variety of clinical sites are needed to provide students diverse learning and training opportunities. These practice opportunities are needed to prepare students to become independent professional heath care workers. One solution to this problem is to establish a virtual skills laboratory software program. The stakeholders for this project will be the college, instructors, students, parents, and the future communities that these students will be working in. Organizational Structure There is an organizational structure that depicts the framework for running Jersey College (Appendix A). There is a board of directors that hold the governing power. The Chief Executive Officer (CEO) is included in this group. The budget and financial management of the college is overseen by the CEO. The board hires the president of the college. Presently the president of Jersey College is Steven Litvak. He responsible for organizing, constructing, executing, and assessing the financial aspect of the college. The president is responsible for maintaining and establishing the mission, purpose, and policies of the college. The nursing education department is led by the Dean of Students. The education department is split into the Practical Nursing Program and the Professional Nursing Program. The two combined programs have a budget for educational needs. If a large purchase needs to be approved the department must submit a written request to the Dean of Nursing. The request is then submi tted to the president who then submits the request to the Board of Directors. The school is accredited by the Council on Occupational Education (COE), New Jersey Higher (NJ) Education, and the New Jersey State Board of Nursing (Jersey College, 2014). The department of Health and Human Services (HHS) has supported grants that will sponsor a wide variety of research grants to improve the quality, safety, effectiveness, and efficiency of health care in the use of technology. My plan is to apply for a grant called Faculty development: Integrated technology into nursing education and practice (ITNEP). The US Department of Health and Human Services (HHS) (2014) offers a grant that provides support to nursing collaboratives for faculty development in the use of information and other technologies in order to expand the capacity of collegiate schools of nursing to educate students for 21st century health care practice. Nursing collaboratives will use health care information systems to enhance nursing education and practice, optimize patient safety, and drive improvements in health care quality (HHS, 2014, para. 1). Assessment of Readiness Jersey College has a very small simulation lab that has very poor ventilation and very few nursing supplies. There are currently two students in my group that have latex allergies and cannot physically work in the skills lab without having allergic reactions. The students often complain that, even though there are many mannequins, there are no simulators that attach to the mannequins. Many of the other machines and supplies are in disrepair. The mannequins’ teaching capabilities are outdated. Many of them have missing limbs or do not have anatomically correct parts. For example, one of the mannequin’s tracheostomy hole is drilled incorrectly so that the student can only put in the tracheostomy tube upside down. The students do not feel that they are truly getting exposure to best practice in the present skills lab. The cost of replacing the lab has been discussed at many meetings and the concept of implementing a virtual lab has been in committee for the past year. The committee has researched many options and has come up with pros and cons of switching to a virtual lab. With the assistance of community and government funding options, the future of a virtual skills lab appears to be on the horizon. According to the Joint Commission (2014), one of the major causes of a sentinel event in the United States is the lack of communication. This means miscommunication is usually demonstrated in the form of â€Å"wrong patient, wrong site, and wrong procedure†. A sentinel event is a recurring medical issue within a facility that causes patient harm. The Joint Commission has recognized that many of these errors can be avoided by taking a â€Å"time out†. The â€Å"time out† procedure requires a consensus of all healthcare individuals that are involved with the patient. Everyone must stop what they are doing to verify that they have the correct patient; the correct site being assessed; and the correct paperwork/lab results must be verified. Nursing students need to recognize how important it is to verbally and nonverbally communicate with each other to avoid potential medical mistakes. The use of a virtual nursing skills lab can mimic medical situations in a safe and consistent environment. This type of laboratory will provide multiple opportunities for students to interact and communicate with a variety of cyber patients. Nursing students can utilize a virtual environment to learn clinical skills and to practice communication techniques. These skills will be useful when students are interacting with patients, families and other healthcare team members. Currently, the students do not have ample opportunities to access a computer during their class time. Many of the students, over ninety percent, have computers of their own. The nursing program is not currently set up to allow access to class information or other learning materials online. The Dean of Nursing is a very forward thinking person and has petitioned the president to acquire a working virtual laboratory. The Dean and instructors would like to update the school’s equipment and keep the facilities modern and technologically savvy. The new program will keep current students up to date and a new virtual laboratory would be a great way to entice new students into the program. Analysis of Data There are many different types of leadership theories, I chose to use Lippett’s Theory of change. This type of theory decrees that a leader is needed to promote the need for change. Lippitt, Watson, Westley (1958) utilized the basics of Lewin’s Theory of Change which included the concept of freeze, unfreezing and refreezing. Lippitt expanded on Lewin’s theory by adding four more steps. Lippitt et al. (1958) discovered that: Maintaining a favorable balance of forces is a continuous job for the change agent and client system, beginning with the initial decision to undertake a change project or helping relationship and continuing until the project has been completed (p. 73). Lippitt’s Theory of change has seven phases. Phase 1: Recognize there is a problem The problem is that the current hands-on skills laboratory is out of date and in need of a massive facelift. The cost of this renovation would be staggering to the institution. Phase 2: Assess the motivation and capacity for change The students, as well as faculty, have voiced their opinions that either a new skills hands on laboratory or virtual laboratory needs to be added to enhance the teaching/learning capability of the school. Phase 3: Assess the resources and motivation of the change There is a grant and government funding for the school to replace the current lab with a virtual one. Many of the faculty have gone back to school and have been exposed to new technological advances. Virtual software can provide nursing students with a multitude of learning opportunities that cannot always be accessed in the â€Å"real† world. The faculty is eager to learn how to work within an online environment. They have stated that they are willing to be instructed in how to run this type of lab. Upper management is willing to put in the time and energy that is necessary to make this change. Phase 4-Design the progressive stages of change The stages that will take place will be: Have a representative, from the selected virtual laboratory software company to come and speak to those staff members that have volunteered to be â€Å"Super Users†. Implement a training sessions for â€Å"Super Users†. These are fellow colleagues that that are given extensive training to assist others in transitioning to a new product or service. Meet with the nurse managers to provide training using the new laboratory software. Answer all questions and concerns that may affect each individual instructor’s educational needs for each specific laboratory classroom. Provide training sessions for educators to provide each instructor guidelines for the new software. Go â€Å"live† with the virtual laboratory software with students. Phase 5: Ensure the role and responsibility of the change agent is clearly understood Clearly identify as many of the problems as possible to fix prior to going â€Å"live† with the program. Ensure that everyone that works with this change will have technical backup and support. Confirm that there will be a representative from the company to answer any and all questions. Phase 6: Maintain the change through communication, feedback, and group coordination There will be evaluation forms for managers and students to provide feedback. Users will be surveyed to evaluate any changes that may be needed to support their teaching/learning needs. The evaluation will be an ongoing process. As problems arise, there will be a representative available on site or by telephone to assist any users. Phase 7: Gradually remove the change agent At the initial phase of the project, there will be a representative on site to help anyone who is having trouble accessing or understanding how to navigate the new laboratory software. After the first six or eight weeks, the physical presence of the software company will no longer be on site but, there will always be twenty-four hour telephone support (Lippitt, Watson, Westley, 1958). Plan for Change After careful research, by a chosen committee, a specific software program will be bought by the college. The college is currently looking into the software called â€Å"The Digital Clinical Experienceâ„ ¢Ã¢â‚¬  made by Shadow Health. Farmer (2014) states that there are over four hundred colleges and universities that are currently using this type of software in their nursing programs. The article goes on to state that the Shadow Health’s program â€Å"is broken down into ten modules, each of which correlate with a body system students study in class† (Farmer, 2014, para. 10). The acquisition committee has a chairwomen that will contact the software developer and set up a demonstration of the product. The committee members will have the opportunity to talk to one of the four hundred present user sites and observe the software in action. Once the decision has been made to purchase this program, the training will begin. Phase I will be the technical part of installing and updating any computer equipment that the school has. Phase II will be educating and training the instructors and â€Å"Super Users†. Phase III will be educating the students and remaining faculty. Phase IV Take the program â€Å"live† and start assigning lessons within the software website. There will be follow up meetings and suggestion boxes to evaluate the staff and students feedback in using this new system. The staff and students need to feel like their suggestions and feedback will make a difference in promoting advanced learning. The amount of money it will take to update, install, and train faculty and students will be added into the cost of tuition. The research committee has evaluated the cost and have estimated that the increase in semester cost will be two-hundred and fifty dollars per student. There will be opportunities for students to reduce this cost by applying for grants and/or financial aid. Evaluation As with any change, it will take time and dedication for staff and students to get used to the new software and work within an online environment. There will be an initial survey for students and faculty prior to starting the online learning lab project. After the software has been up and running for six months, a follow up survey will be given to evaluate the student’s and staff’s perception of the learning quality provided by the software. The students should be aware that there will always be technical support available to them and that instructors will be reasonable regarding grades and assignment within this initial new setting. The students should be contacted, by the instructor, via email numerous times throughout the semester and asked if they are experiencing any issues or concerns with the new software (O’Neil, Fisher, Rietschel, 2014, p. 134). Mens Rea And Actus Reus Of A Crime Two elements comprise nearly all crimes, a guilty mind (mens rea) and a guilty act (actus reus). An act does not make a man guilty of a crime, unless his mind is also guilty. It is, therefore, not the act which is guilty but respectively the man and his mind. A substantiation of an actus reus is required in every crime. Also, there is a presumption that every element of the actus reus needs proof of a consequent mens rea. Where the presumption of mens rea is not applicable, such offences are called strict liability crimes. Most crimes have the element of a mens rea. It must always be proven by the Prosecution that an unlawful conduct is committed by an accused. Furthermore, it will usually have to be proven that the accused committed with guilty mind in engaging such conduct. For instance, to ensure conviction for rape in contradiction to s.2(1), 1981 Criminal Law (Rape) Act, it must be proven by the Prosecution that the accused committed unlawful conduct (i.e., non-consensual sexual intercourse with a woman), knowing that no consent is given by the woman or being thoughtless regarding whether or not the woman was consenting (mens rea). If the guilty act (actus reus) involves the particular outcome which the criminal conduct of the accused caused, a mens rea may have to be proven by the Prosecution as well with regard to the particular outcome. The actus reus, for instance, in the crime of assault producing injury in contradiction of s.3, 1997 Non-Fatal Offences against the Person Act, is criminal act, i.e., an assault, and a distinct outcome (i.e., injury). Intention and Mens Rea It is impossible to explore somebodys mind to determine their intentions.  [3]  The meaning of intention, in line with s.14, 1861 Offences against the Person Act, deliberated by the Court of Criminal Appeal in The People (DPP) v. Douglas and Hayes,  [4]  provides that whoever shall fire at any person with the intention to carry out murder shall be guilty of a felony, whether or not it will result to any physical harm. The Special Criminal Court convicted the applicants inter alia of an offence in contradiction of s.14 of the 1861 Act. They argued successfully that the requisite intent under s.14 had not been proven. The courts judgment was conveyed by McWilliam J, stating that unless intent has actually been expressed by the accused, the intent of the accused can only be determined from a consideration of his actions and the surrounding circumstances. What the accused intend or did not intend, only he can know such. Apparently, if the accused expressed the intention to do a thing and carried on to accomplish that intention, proving that the accused acted with intent will be reasonably simple. Conversely, lacking such an expression, intention is harder to prove and other statements expressed by the accused must be considered by a jury or judge as well as the actions of the accused and the circumstances surrounding the case in coming to a decision whether intention is to be inferred or not. Omissions Liability and Actus Reus Precisely what is meant by conduct is commonly referred to as an act. In criminal liability, an omission or a part thereof cannot form the actus reus of a crime as a general rule. As stated by McAuley and McCutcheon,  [5]  the common law traditionally disinclines to punish omissions and to illustrate this time honoured example, watching an infant drowning in a shallow pool by an able-bodied person does not constitute an offence. But this principle is also subject to exceptions. The accused in DPP v. Bartley  [6]  had been convicted of different sexual offences. Carney J on passing judgment commented that where a believable complaint of felony is presented to a policeman, the policeman under the Common Law has no discretion in not investigating the complaint and arrest the indentified offender. This duty if not carried out strongly constitutes on the part of the policeman an illegality and makes him liable to prosecution on indictment. Palles CB remarked in Creagh v. Gamble  [7]  that a person shall be brought to justice where a credible suspicion of a felony is present against him. The Peace Officer is entitled and duty bound as well to apprehend him. This Common Law principle still applies. This was substantiated in R. v. Dytham.  [8]   Concurrence of Mens Rea and Actus Reus If mens rea is to be proven by the Prosecution, it must moreover establish that mens rea existed at the time of the actus reus. At times whether the actus reus and mens rea concurred may not be apparent. The accused in Kaitamaki v. R.  [9]  was charged with rape. Having sexual intercourse with a woman without consent is the actus reus of rape. Knowing that it is non-consensual or whether there is consent or not by being reckless is the mens rea of rape. It was established that the woman initially consented to have sexual intercourse with the accused. In spite of the subsequent withdrawal of the womans consent, the accused persisted and did not desist from having sexual intercourse. It was contended by the accused that at the time of the actus reus (i.e., penetration), consent was present, hence, he did not have a mens rea. Lord Scarman, the Privy Council, rejected this contention by stating that the act of sexual intercourse is continuing and ends only with withdrawal. Accordingl y, the woman had the right to withdraw her consent at whatever time during sexual intercourse, even though she had initially given consent to penetration. The case of Kaitamaki v. R.  [10]  can be referred to in sustaining the proposition that an actus reus entails a continuing act, and as such, in order to ensure a conviction, the accused must be proven to have the required mens rea at some period during its continuation, although it is not essential to establish that at the outset the requisite mens rea was present with the accused.

In this paper I will be comparing the visit to the State Mental Institution and the movie One Flew Over a Cuckoo's Nest. I think the two aspects of metal illnesses has had a effect on the way I see people who are not mentally stable. The three topics that are being compared are; staff concerns, spiritual development, and treatment methods. In the movie One Flew Over a Cuckoo's Nest the staff concernments was different from the staff concernments at the mental institution. In the movie nurse Ratchet was an bad influence to the patients who needed to be helped in the social groups. Instead of nurse Ratchet listening to the patients, she patronized and compressed them into their own kind of thinking. I think instead of helping them, Ms. Ratchet only mad the worst come out of the patients because of the way she downed their inner feelings and did not treat them as real people . From the visit at the State Hospital, the staff seem to real care about the patients and their mental stableness. I think with most mental illness people can really get help from people who actually care. If the staff really listen to what their patients have to say, then a patient can only be lead to better health. I think in any mental institution spiritual development with God should be allowed regardless of anything. In the movie, there really was not anything spiritual that was talked about. I think that if the nurse's and the patients had a spiritual side to them, then the sessions that took place could have been more helpful to the patients. In the State Institutionone staff memeber, told us that spirituality was show in the institution, but not to much because the staff members do not want to force their religion on the patients. The ways of treatment to the patients was an huge difference between a movie and reality. In the movie the shock treatment was heavily used for the patients who would get out of hand in the sessions. I thought that was nurse Ratchet crazy way to deal with the patients mental illnesses. In the movie there was also a time called; Medicine Time, where the patients would line up to take their medicine. In the State Institution we really did not see any patients lining up for their medicine, because they were treated like people.

The Clash of Races Africa has always been the centre of colonization for many European countries. With its colonization came stereotypes of African’s being inhumane, primitive and savage in comparison to the humanity of the civilized Europeans. The tradition model simplifies the stereotypes into Africans are bad and Europeans are good. Fortunately, it is not as clear cut as this. In Things Fall Apart, by Chinua Achebe, both the Igbo of the Umuofia and the British of Europe have good sides and dark sides of their respective races revealing that traditional perceptions of these races are not entirely accurate. Through their systems of government, court systems and religion both parties have the positive and negative effects on each other. As the traditional model states, the Europeans did have a positive effect on the Africans of Umuofia. Firstly, the British missionaries built a hospital for the people of the village. The villagers state that the â€Å"White man’s medicine was quick and worked well† (181). They shared the European knowledge of medicine with the villagers and this vastly improved their health and overall well-being. In addition, the Europeans built a school for the people of the Umuofia leading to them acquiring jobs. In particular, â€Å"A few months in were enough to make one a court messenger or even a court clerk (181).† The schools also taught advanced and knowledge based positions to the villagers too. For example, â€Å"[T]hose who stayed longer became teachers† (181-182). This passing of knowledge assisted the African society to become more educated and helped them get an occupation in the future. Contrary to the traditional model, the Africans of the Umuofia village are civil and humane. Similarly, the Europeans in general also demonstrate both humanity and inhumanity through the massacring of an entire tribe and in imprisoning many Africans who do not conform. They also attempt to enlighten the Africans by providing jobs and medicine. To conclude, one cannot simply say the Europeans are superior and Africans are inferior. In today’s society, many stereotypical people are in existence and will forever exist but are those people not supposed to be progressing forward not reverting back to segregation?

This is how it began five years ago. I had played on a soccer team for several years. As I grew older I began having difficulty playing soccer because of shortness of breath. I was diagnosed as having mild asthma which ended my soccer career and eliminated my participation in most physical sports. Shortly afterward, during a Boy Scout summer camp, I participated in riflery at their shooting range. This was the first time I had ever touched a firearm. To my amazement, I won the camp's first place award for marksmanship. I was more than eager when a friend of mine asked me if I would like to join a shooting club. My parents were wary when I asked to join the rifle club. My mother feared guns, but my father felt there was no problem with trying this sport. Gratefully, he gave me the opportunity to try rifle marksmanship, despite secretly hoping that I would quit. Both of my parents were afraid of what people would think about their son's involvement with guns. Like my parents a majority of people believe that all firearms are dangerous to our society. All they remember are the hysterical news releases of street violence and injured children. I am often asked how many deer I've shot. Frankly, I could never bring myself to injure another living creature and neither would most of the competitors I have met.
